APPLICABILITY
Flights Covered:
- Applies to flights departing from an EU airport and flights operated by a community air carrier departing from a third-country airport to an EU airport.
- Conditions: Confirmed reservation, timely check-in, applicable fare, and KM Malta Airlines Limited as the operating carrier.
Rules for Assistance:
Delayed Flights:
- For delays beyond:
- Two hours for flights of 1500 km or less.
- Three hours for intra-community flights over 1500 km and other flights between 1500 and 3500 km.
- Four hours for all other flights.
- KM Malta Airlines provides:
- Meals and refreshments.
- Two telephone calls, telex, fax messages, or emails.
Extended Delay and Overnight Stay:
If the delay extends to the day after the originally announced time:
- In addition to meals and communications assistance, KM Malta Airlines offers:
- Hotel accommodation for one or more nights.
- Transport between the airport and the place of accommodation.
Five-Hour Delay and Reimbursement:
If the delay is at least five hours and you choose not to travel:
- In addition to meals and communication assistance, KM Malta Airlines reimburses the full ticket cost.
- Reimbursement methods: Cash, electronic bank transfer, bank orders, bank cheques, travel vouchers, or other services.
Compensation for Delays:
When the delay exceeds three hours (excluding extraordinary circumstances), compensation is provided:
- EUR 250 for flights of 1500 km or less.
- EUR 400 for intra-community flights over 1500 km and other flights between 1500 and 3500 km.
- EUR 600 for all other flights not falling under the above categories.
Timing of Assistance:
Assistance is provided within the time limits specified for each distance bracket.
Legal Rights and Further Compensation:
Assistance granted doesn't affect any additional rights under applicable law (including EU Directive 2015/2302 on package travel).
