Cancellation Notice

APPLICABILITY

  1. Applies in the event of the non-operation of a flight previously planned by KM Malta Airlines Limited with at least one reserved seat.
  2. Applies to flights departing from an EU airport and flights by a community air carrier departing from a third-country airport to an EU airport (unless benefits or compensation were received in that third country).
  3. Requires a confirmed reservation.
  4. Applies to passengers traveling at a fare available to the public, directly or indirectly, or on tickets issued under a frequent flyer or commercial program.

Rules for Compensation and Assistance:

If your flight is cancelled, KM Malta Airlines Limited will offer:

I. A choice between:

          a) Reimbursement of the full cost of your ticket for the uncompleted journey or the entire journey if no longer serving the original travel plan, with a return flight if applicable.

          b) Re-routing to your final destination under comparable transport conditions, at the earliest opportunity.

         c) Re-routing to your final destination at a later date at your convenience, subject to seat availability.

II. Additional assistance includes:

          a) Meals and refreshments.

          b) Two telephone calls, telex, fax messages, or emails.

III. In the case of re-routing with a delay:

          a) Hotel accommodation if a stay of one or more nights becomes necessary.

          b) Transport between the airport and accommodation.

IV. Compensation entitlement unless:

          a) Informed at least two weeks before the scheduled departure.

          b) Informed between two weeks and seven days before, with re-routing options meeting specific criteria.

          c) Cancellation caused by extraordinary circumstances unavoidable with reasonable measures.

Compensation amounts:

  • EUR 250 for flights of 1500 km or less.
  • EUR 400 for intra-Community flights over 1500 km and other flights between 1500 and 3500 km.
  • EUR 600 for flights beyond the mentioned categories.

Reduction possibility if re-routed flight arrival time is within certain limits. "Final destination" is defined based on the presented ticket at check-in or the last flight for directly connecting flights.

Assistance applies without prejudice to other rights under applicable law, including EU Directive 2015/2302 on package travel.

This notice is required by Regulation EC 261/2004 of the European Parliament and the Council of the European Union.
